TERMS AND CONDITIONS

Last Updated: 22.08.2016 This User Agreement ("Agreement") is set between all users whom visit the www.letspepapp.com website ("website") or download the Pepepp mobile application ("Application") and the Pepepp Inc BV located in 1101CJ Karspeldreef 6B, Amsterdam ("the company" or "Pepepp"). This agreement sets the terms of use, the rights and obligations of the parties. By visiting the website or downloading the app to your mobile device you agree to be bound by these Terms.

The Company's Rights and Obligations

The company will provide it's users who have downloaded the app, advisory information in these stated areas: Health, lifestyle, nutrition and fitness. The company cannot be held responsible for the use of recommendations regarding the information and advice that it provides during the use of the application such as health, lifestyle, nutrition and fitness. The company is not responsible for interruptions or delays that may occur due to internet problems, acts of third parties, connection problems and problems that are caused from suppliers. The application is for individual use. The company can cancel the membership, suspend the user or may terminate the account altogether if it is determined that the user is using the app contrary to the purpose of use. Purchases within the application will be sent immediately to the user's mobile device. It is requested that the user's mobile device is connected to the internet via Wi-Fi, in order to access the App Store or the Google Play Store. The General Terms and conditions will apply for the App Store and the Google Play Store depending on the type of the mobile device and App Store or Google Play Store. The in-app purchases about suggested offers are valid for that exact time, the price and offer may change after. Pepepp will gather some personal information (such as name, age, interests, location information, height, weight, email, etc.) in order to provide better service to users. This information is collected in Pepepp servers and the computers can be used within Pepepp studies such as; periodic public campaigning for custom design and promotional activities, for customer profiling and customer classification for managing unwanted messages. Pepepp is integrated with the Apple health application and is compatible with the heathkit Google fit platforms. Pepepp, does not share the user information and data for any kind of commercial purposes without the users approval, regardless of the platform which the user provided their personal information from.

Rights and Obligations Of The User

It is the users obligation to fill in the information required fully and accurately and update this information when necessary. The user is responsible for the incomplete and non realistic information provided. The user confirms that she/he is over the age of 13. The user must be at least 13 years old in order to use this app. Users under 13 years of age may not use the application under any circumstances. Users over the age of 13 but under the age of 18 is considered to have received the express approval of this Agreement by a parent or guardian. The user is informed and accepts that this application works with an internet connection. The application content such as video, text, and images that can be displayed with an internet connection will be covered by either a Wi-Fi connection or the user's mobile internet package. The daily advice and guidance provided in the app is for information purposes only. The user knows that the content about health, lifestyle, nutrition and fitness advice is informational and accepts sole responsibility for use of information. these advices have been prepared on the assumption that the user does not have any medical conditions. These applications are not specified to the person. The user should consult a doctor about health issues before using content. When there is a risk or serious medical condition of the user, the implementation of these programs are not recommended. If the user has any questions about her/his health condition, she/he must always consult with a physician or another health care professional. The application does not provide diagnosis or treatment of any disease or health condition. The user accepts that any advice and recommendations given by the application is not a substitute for a doctor prescription or professional advice and takes full responsibility. The user may always request the information about the stored data related to the user and the deletion of this information from the company itself. The company can always send notifications and electronic messages to the user. During the contract period and even after the user had ended the contract, the company and/or the 3rd parties which are doing business with the company can send commercial electronic messages for marketing and advertising purposes and in this context, fax, electronic mail, short message or other automated systems with no further approval needed. To exit the user's system the user can send an e-mail to [email protected] and transmit their request. The company can use the personal information provided for further analysing, conduct research and statistical studies. This information can be used for both the user and for scientific purposes. The user information which has been entered by the member will be stored within the application for a period of one year even after the app has been deleted. If the data is going to be used for medical research, Pepepp will not use the data without the approval of the user. If the user is under age the approval of parents or guardian will be needed. The Pepepp application tracks user behaviour during the use of application and analyses visitor preferences. The statistical data which does not contain personal information, can be shared with Pepapp business partners for the purpose of maintaining a more private experience to Pepapp users. Pepapp is not responsible for any damage or complications that may occur due to the lack of accurate data provided by the user or provided by the 3rd party applications with the approval of the user. Pepapp also does not take any responsibility, for failures which can occur while transferring user data from other applications. User information, can be provided to public authorities upon request only when in accordance with applicable mandatory provisions of the legislation. Information that the user has provided can only be changed upon the user's request.

CAMPAIGNS

Pepepp may launch campaigns through the app or website from time to time for the benefit of members and offer various discounts, gifts, opportunities, offers etc. All the Terms and Conditions will be held by Pepepp. Campaigns that are launched by a periodical basis for the apps services with a fee only applies for users who are currently on a standard membership. Users who have existing paid or premium memberships may not benefit from such campaigns or combine them with their existing membership. Pepepp reserves all rights related to the campaigns such as making changes to the content, execution of the campaign and all kinds of special offers.

THE USER'S RIGHT TO WITHDRAWAL

The consumer is a person without any commercial or professional purposes and the right of withdrawal applies to consumers stated above. Since the application is downloaded over the internet directly by the user, the user always has the option to withdrawal from the application by removing the application from the mobile device at any time. The withdrawal conditions concerning in-app purchases for Google Play Store or the App Store is subject to the General Terms and conditions. The company holds all rights reserved in cases where, the user of the service wishes a refund of the payments which have been charged.

PAYMENTS

The application is free and for the in-app purchases the user will need to check and approve the sale price including all taxes. The user accepts all changes made by the company regarding user campaigns and packages. The user who has bought a monthly or annual prepaid memberships via a campaign cannot ask for cancellation or a refund. The user accepts that the campaign will continue until the end of the period of prepaid Membership. Paid services: The company's certain services may be subject to payment now or in the future ("Paid Services"). All that is reported to the user during the use phase for paid services or membership and the payment terms are a part of this contract. Billing: The company, accepts payment for the use of the premium services to the company's account ("billing account") and for the user to issue an invoice, uses a third-party payment processor ("payment processor"). The payment process, will be included to the terms of the contract, and will be subject to the Terms Conditions and privacy. The company is not responsible for any errors that occur due to the payment processor. By selecting the paid services, the user accepts that the company can take all fees through payment processors in the current pricing payment services and agrees to pay via payment processor the user's chosen payment provider ("payment method") which allows the company to complete payment action. The user accepts using the payment method bu clicking pay. Even if the request has been sent or payment has been made the Company reserves the right to correct any errors or problems. Payment method: The payment terms of the users will be related with the chosen payment method or credit card providers or financial institutions and will depend on the provisions of the contract between the user and these providers. If the company is unable to obtain payment from the payment processor, the user accepts to pay the entire amount payable upon first demand to the company. Continuous Billing: As accepted by the user on first use, a service may including continuous pricing after a one-time charge has been paid. By accepting the first payment of the continuous billing service provided, the user also accepts to pay the continuous fee untill cancellation. For cancellation the user will need to send the company a notice in advance. Until the user is given the approval to terminate or change the payment method by the company, it can offer and accept periodic (monthly, etc.) payments. This notice will not affect past payments that have been sent. The user can terminate this authorization or change the payment method to purchase in the Play Store or the Apple Store, which is connected and will be navigated to the membership page. Up-to-date information: Users must provide current, complete and accurate information for their billing account. The users will need to keep this information up to date, complete and accurate without delay to keep all updates (billing address, credit card number or credit card expiration date in the event of a change, such as payment methods) and if it was cancelled (e.g. for loss or theft) or the possibility of a breach of security is realized, the user must immediately notify the company or the payment processor. These changes can also be made from the security page on Apple Store or the Play Store. If the user does not provide any of the above mentioned, she/he agrees to continue to receive payments until the membership has ended as stated above. The Approved Amount Of Changes: If the user’s billing payment amount that will be withdrawn from the account is different than the amount approved in advance, (as distinct from the amount of tax, or a change in responsibilities) the user is entitled to be informed of the amount that will be withdrawn from the account a day before. The provisions of the agreement between the payment provider and the user will be applied to the payment method. The user accepts the billing period to be related to the operations of the company which can deliver the billing immediately or collectively. The Approval Verification: As the user continues to use paid services, or cancel these services, the company's billing for these services mean that the user has consented to the payment method. The company can keep an invoice for the amount of the debt to be paid and the user is responsible for paying these amounts. Service usage fees can be paid in chosen method such as; in advance, paid by usage when using the service, regularly, pre-selected. Free Trials and Other Promotions: All the promotions that provide access to premium services for a trial version should be used within the specified time frame. The user should stop using the paid service before the end of the period to avoid any pricing after the trial. If the user stops using the trial version before the end of the period, and in spite of this, if a fee is charged they can contact [email protected] for information.

LICENSE

By submitting the user application, the user accepts and gives a continuous and unlimited global license to the company for the usage of this information. Products and services may also be purchased for additional features or to improve the performance. For any disagreements that will occur regarding this Agreement, the Turkish law is to be applied, and the case is to be seen in Istanbul courts and shall be authorised by the consumer court.

Privacy Policy

Pepepp will gather some personal information (such as name, age, interests, location information, height, weight, email, etc.) in order to provide better service to users. This information is collected in Pepepp servers and the computers can be used within Pepepp studies such as; periodic public campaigning for custom design and promotional activities, for customer profiling and customer classification for managing unwanted messages. Pepepp does not share or sell the information gathered from the membership forms with third parties, for any commercial purposes. Pepepp, analyzes data not only by e-mail addresses, and membership forms but also by following user actions during the use of the application. Statistical data that does not contain personal information, are provided to partners in order to provide Pepepp customers a more special experience. Apple iOS users can share health information with Pepepp collected in the health application. Users may decide the information that will be shared by simply accessing the Apple iOS Health app in settings. Pepepp does not store personal health information on iCloud, it does not use your data for advertising and marketing purposes and does not share information with third parties without user's consent. The health app information is only used for improving the user's health and fitness in order to motivate and achieve goals. User information, can be provided to public authorities upon request only when in accordance with applicable mandatory provisions of the legislation.
